D&D Coverage Alert #1

Like back in 1949 during the California Gold Rush, we are now seeing a 21st Century boom in the new residential building industry. So the Insurance companies are tightening the reins on the mules.

Please double check and review the definition of “Project” for your sub-contractor or general contractor liability policies. When it comes to residential construction defect claims, we are seeing policy language, including “Project” endorsements that limit or exclude coverage. We are finding a limit on the number of Homes within the overall housing development.  Not to be confused with the total homes worked on by the Insured.

The “Project” is the TOTAL number of homes within the development. This includes ALL Phases, present and future. So if the insured is only contracted to work on 50 homes, but the Project has a total development of 100 homes, this endorsement could exclude coverage.

The intent of the endorsement is to limit the construction defect exposure. The higher the number of homes within the Project will increase the potential for construction defect lawsuits. That is why they limit the number of homes on the endorsement.

So please remember to double check the insurance application questions, policy language and recognize any “Project” endorsements.

IIABCal: Legislative Update on Fire Insurance Legislation Proposed In 2018

There is the potential to be as many as 30 fire insurance related legislative measures introduced by the February 16, 2018 bill introduction deadline for the year, the majority of which to be potentially sponsored by California Insurance Commissioner Dave Jones.

These are currently proposals, with the exception of those in Section I which have been formally introduced. The following is intended to provide a primer on potential legislative action in this issue area.

Announcement: State Fund Premier Agency 2018

“As you may have heard,  we have been recognized as a Premier Agency for State Fund beginning 2018. This designation is extremely exclusive to a small percentage of Brokers in the state. As a result of the designation, we will be receiving 12% commission on accounts renewing 1/1/18 going forward. If your term sheets for 1/1/18 business do not reflect 12%, it is an internal system issue that will be corrected to reflect the correct commission amount at later time. We will be monitoring through accounting as well. Do not hold up renewals for this issue. Needless to say, this is a very positive development for our Company and important to our overall relationship with the State Fund.  Should you have any questions on this, let me know. Thank you.”

The D&D Project: Wants and Wishes 2017

Here is the latest from Fresno’s D&D Project Committee:

Season’s Greetings from all of us on the D & D Project Committee.  It has been a very busy year for us and now we find ourselves preparing for the Christmas Holidays.  Once again we will be supporting the Children in the Pinedale Community with “Wants and Wishes”.  Our tree is up and each child has a tag with their name, age, size and like hung on the tree.

A green basket and pen will be next to the tree. Please take the ornament and tear off the tag that lists the child’s name and add your name as the D & D giver  and place in the Green Basket.  You have untilTuesday, December 19th at Noon to return your wrapped gifts. Cash donations are always accepted and you can give your donation to any D & D Project member. Please make checks payable to The D&D Project.

Our Back To School Supplies were a big hit. We as well as Zenith, provided most of the items on the school supply lists for Pinedale and Washington Union. They are always grateful.

We will have our traditional Christmas 50/50 raffle and gift raffle right before our Christmas Luncheon on Friday, December 15th.Further information will be sent out regarding this event in the near future.

We thank you for supporting the D & D Project.  Each year with your support we are able to reach out and help more children.  You are the light in the window for many of these families.  You help to make a big difference in their lives!!

Please see Darlene A., Theresa R., Patty, or Richard if you have any questions or if you would like to make a donation.
